In Plain English

TeachPlan is a lesson planning tool. You can use it for free with basic features, or pay for advanced features. You own your content (lesson plans, resources). We provide the service "as is" and are not liable if something goes wrong. Be respectful, don't abuse the service, and we'll do our best to keep things running smoothly.

1. Acceptance of Terms

By accessing or using TeachPlan ("the Service"), operated by TeachPlan Pty Ltd ("TeachPlan", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms constitute a legally binding agreement between you and TeachPlan Pty Ltd, an Australian company.

2. Description of Service

TeachPlan is a web-based lesson planning and curriculum tracking platform designed for NSW educators. The Service allows you to:

  • Create and manage lesson plans and teaching programs
  • Track curriculum coverage against NSW syllabuses
  • Manage class timetables and schedules
  • Store and organise teaching resources
  • Collaborate with colleagues (on eligible plans)
  • Record teaching reflections

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

3. Account Registration and Security

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information as necessary
  • Maintain the security and confidentiality of your login credentials
  • Notify us immediately of any unauthorised access to your account

3.2 Account Responsibility

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to maintain account security.

3.3 Age Requirement

You must be at least 18 years old to create an account. The Service is intended for professional educators, not students.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Upload or transmit malware, viruses, or other harmful code
  • Attempt to gain unauthorised access to any part of the Service
  • Interfere with or disrupt the Service or servers connected to it
  • Use the Service for any commercial purpose not authorised by us
  • Share your account credentials with others or allow others to access your account
  • Scrape, crawl, or use automated means to access the Service without permission
  • Upload content that is offensive, harmful, or inappropriate

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Intellectual Property

5.1 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by TeachPlan Pty Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

5.2 NSW Curriculum Content

NSW syllabus content displayed within the Service is owned by the NSW Education Standards Authority (NESA). This content is provided for reference purposes in accordance with NESA's usage guidelines.

6. User-Generated Content

6.1 Your Content

You retain full ownership of all content you create or upload to the Service, including lesson plans, programs, resources, and reflections ("Your Content").

6.2 License Grant

By uploading Your Content, you grant TeachPlan a limited, non-exclusive, royalty-free license to store, process, and display Your Content solely for the purpose of providing the Service to you. This license terminates when you delete Your Content or your account.

6.3 Content Responsibility

You are solely responsible for Your Content. You represent that:

  • You have the right to upload and share Your Content
  • Your Content does not infringe on the rights of any third party
  • Your Content complies with all applicable laws and these Terms

6.4 Content Removal

We reserve the right to remove any content that violates these Terms or that we reasonably believe may create liability for us.

7. Subscription and Payments

7.1 Free Plan

TeachPlan offers a free plan with limited features. The free plan is provided "as is" and may be modified or discontinued at our discretion.

7.2 Paid Plans

Paid subscription plans offer additional features and higher usage limits. By subscribing to a paid plan, you agree to pay the applicable fees as displayed at the time of purchase.

7.3 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • Prices are displayed in Australian Dollars (AUD) and include GST where applicable
  • We use third-party payment processors; your payment information is handled according to their terms

7.4 Cancellation and Refunds

  • You may cancel your subscription at any time
  • Upon cancellation, you retain access until the end of your current billing period
  • Refunds are provided at our discretion and in accordance with Australian Consumer Law
  • Annual subscriptions may be eligible for a pro-rata refund if cancelled within 30 days

7.5 Price Changes

We may change subscription prices with 30 days notice. Price changes will not affect your current subscription period.

8. Termination

8.1 Termination by You

You may terminate your account at any time by using the account deletion feature in your settings or by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

8.2 Termination by Us

We may suspend or terminate your account immediately if you violate these Terms or for any other reason at our sole discretion. We will provide notice unless we reasonably believe notice would cause harm or violate the law.

8.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete Your Content after a reasonable retention period
  • Provisions that should survive termination (such as intellectual property rights, disclaimers, and limitations of liability) will continue to apply

9. Disclaimers

9.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Guarantee of Availability

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • Defects will be corrected
  • The Service or servers are free of viruses or harmful components

9.3 Educational Content

While we strive to provide accurate curriculum information, we are not responsible for errors in syllabus content. Always verify curriculum requirements with official NESA documentation.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TEACHPLAN PTY LTD, ITS DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Any damages arising from your use or inability to use the Service
  • Any content obtained from the Service or actions taken based on such content

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve (12) months prior to the claim.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded under Australian Consumer Law.

11. Indemnification

You agree to indemnify and hold harmless TeachPlan Pty Ltd and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your Content

12. Governing Law and Disputes

12.1 Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

12.2 Dispute Resolution

Before initiating legal proceedings, you agree to attempt to resolve disputes informally by contacting us. We will endeavour to resolve disputes within 30 days.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date at the top
  • Sending an email notification for significant changes (if you have an account)

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TeachPlan regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign your rights under these Terms without our written consent. We may assign our rights without restriction.
